Terms of Use — Across America

Effective date: November 6, 2026

These Terms of Use (“Terms”) apply to your access to and use of the Across America website at acrossamerica.com, including its pages, content, and features (collectively, the “Site”). The Site is operated by Across America Financial Inc. (“Across America,” “we,” “us,” or “our”), a company registered in Florida.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. What the Site Provides

Across America is developing an informational gateway to financial products and services that may be offered by participating third-party providers, including providers in banking, loans, insurance, and investing.

The Site does not offer financial products or services, accept financial applications, or provide financial advice. If and when provider offers become available, the Site may present information to help you explore them and continue to a provider’s website or service. Any application, account, product, or service will be offered and handled by the relevant provider, not by Across America.

Accounts, newsletter, and purchases. The Site may offer user accounts, an email newsletter, and paid products or services (such as access to content or tools) processed through a third-party payment provider (Stripe). Accounts must be kept secure: you are responsible for your account credentials and for activity that occurs under your account. Newsletter subscriptions can be cancelled at any time. Purchases are subject to the pricing and terms shown at the time of purchase. Paid offerings are not financial products, and payment processing is handled by Stripe, not Across America.

Across America is not a bank, lender, insurance company, investment adviser, broker-dealer, or other financial services provider. We do not make lending, insurance, investment, or account decisions, and we do not set provider eligibility requirements or product terms. Providers make their own decisions and are responsible for their products, services, terms, disclosures, and ongoing customer support.

2. No Financial or Professional Advice

Information on the Site is for general informational purposes only. It is not financial, investment, lending, insurance, legal, tax, or other professional advice, and it is not a recommendation, offer, or solicitation to buy or use any financial product or service.

Your circumstances are unique. Before making a financial decision, review the provider’s information and terms and consider speaking with a qualified professional. Do not rely on information on the Site as a substitute for advice tailored to your situation.

3. Third-Party Providers and Links

The Site may identify, describe, or link to third-party providers and their websites or services. Those providers are independent from Across America. Their websites, products, services, applications, privacy practices, terms, availability, and decisions are governed by their own policies and agreements.

We do not control or operate third-party services and are not responsible for their content, accuracy, availability, conduct, products, services, or actions. A link or listing does not mean that we endorse or guarantee a provider. You are responsible for reviewing the provider’s terms and disclosures and deciding whether to proceed. Any questions, complaints, or disputes about a provider’s product or service should be directed to that provider.

4. Eligibility

You must be at least 18 years old to use the Site. By using it, you confirm that you are at least 18 and have the legal capacity to agree to these Terms.

5. Acceptable Use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in a way that violates any applicable law or another person’s rights.
  • Interfere with or disrupt the Site, its security, or its operation.
  • Attempt to gain unauthorized access to the Site, its systems, or related accounts.
  • Introduce malware or other harmful code, or use the Site to distribute it.
  • Scrape, harvest, or collect information from the Site using automated means, except as permitted by law or with our written permission.
  • Misrepresent your identity or affiliation, or use the Site to mislead or defraud others.
  • Copy, modify, distribute, or exploit Site content except as permitted by these Terms or applicable law.

We may suspend or restrict access to the Site if we reasonably believe that you have violated these Terms or that your use poses a risk to the Site, its users, or others.

6. Intellectual Property

The Site and its content—including text, graphics, logos, design, and other materials—are owned by Across America or its licensors and are protected by intellectual property laws. These Terms allow you to use the Site for personal, noncommercial purposes. They do not transfer ownership of any intellectual property to you.

You may not reproduce, distribute, modify, publicly display, or create derivative works from Site content without our prior written permission, except where applicable law permits it. Any feedback or suggestions you provide about the Site may be used by us without restriction or payment to you.

7. Disclaimers

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” We do not promise that the Site will be uninterrupted, secure, error-free, accurate, complete, current, or suitable for your needs. We do not guarantee that any provider, product, or service will become available through the Site.

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes a warranty or right that applicable law does not allow us to exclude.

8. Limitation of Liability

To the fullest extent permitted by law, Across America and its owners, employees, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, or business opportunities; or costs of substitute services arising from or related to your use of, or inability to use, the Site or any third-party service.

To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Site or these Terms will not exceed US $100. This limit does not apply where applicable law prohibits limiting liability, including for liability that cannot legally be excluded or limited.

9. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Across America and its owners, employees, and representatives from third-party claims, liabilities, losses, and reasonable expenses (including legal fees) arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from our own conduct where applicable law does not permit that responsibility to be shifted to you.

10. Changes to the Terms or Site

We may update these Terms or change, suspend, or discontinue any part of the Site. When we update the Terms, we will post the revised version here and change the effective date above. Unless applicable law requires otherwise, updates apply from the date they are posted. Your continued use of the Site after an update means you accept the revised Terms.

Changes to the arbitration and class action waiver provisions will not apply to a dispute for which you have already given us written notice before the revised provisions are posted, unless you agree otherwise.

11. Disputes, Arbitration, and Class Action Waiver

Please read this section carefully. It requires most disputes to be resolved through individual arbitration rather than in court, and it limits participation in class and representative proceedings.

Informal resolution

Before starting arbitration, you and Across America agree to try to resolve a dispute informally. The party raising the dispute must send the other party a written notice describing the dispute and the relief requested. Notices to Across America must be sent to the contact details in Section 14, marked “Dispute Notice.” The parties will try in good faith to resolve the dispute for 60 days after the notice is received. Either party may then start arbitration if the dispute has not been resolved.

Agreement to arbitrate

Except for the exceptions below, any dispute or claim arising out of or relating to the Site or these Terms will be resolved by binding individual arbitration, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

The arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules. If the AAA is unavailable or will not administer the arbitration, the parties will work in good faith to select another arbitration provider that applies consumer arbitration procedures. If they cannot agree, either party may ask a court with jurisdiction to appoint an arbitrator as permitted by law.

The arbitration may be conducted remotely or, if an in-person hearing is required, in the county or parish where you live, unless the parties agree otherwise or applicable law requires a different location. The arbitrator may award any relief available to an individual in court under applicable law. Arbitration fees and costs will be allocated under the applicable AAA rules and law.

Exceptions

Either party may bring an individual claim in small claims court if it qualifies and remains in that court. Either party may also seek temporary or preliminary relief from a court when necessary to protect its rights while arbitration is pending. Nothing in this section requires arbitration of a claim that applicable law says cannot be required to be arbitrated.

Class action waiver

Disputes must be brought only on an individual basis. To the fullest extent permitted by law, neither you nor Across America may bring or participate in a class, collective, consolidated, or representative action or arbitration, or seek relief on behalf of other people. The arbitrator may not combine claims or preside over a class or representative proceeding.

If a court finally decides that this class action waiver is unenforceable for a particular claim or request for relief, that claim or request must be resolved in court after the remaining arbitrable claims are completed, unless applicable law requires otherwise. Any class or representative claim that may legally proceed in court must do so only to the extent the court allows.

Right to opt out

You may opt out of this arbitration agreement by sending us written notice within 30 days after you first accept these Terms. Your notice must include your name, mailing address, and a clear statement that you want to opt out of the arbitration agreement. Send it to the contact details in Section 14, marked “Arbitration Opt-Out.” Opting out will not affect any other part of these Terms.

12. Governing Law and Court Location

Except where federal law governs or applicable law requires otherwise, these Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. For disputes that may be brought in court, you and Across America consent to the state and federal courts located in Florida, subject to any rights you may have under applicable law and the dispute resolution provisions above.

13. General Terms

If any part of these Terms is found unenforceable, the remaining parts will remain in effect, except as stated in the arbitration section. Our failure to enforce a provision is not a waiver of our right to do so later. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations as part of a merger, reorganization, or sale of assets, to the extent permitted by law.

These Terms, together with any policies expressly incorporated into them, are the entire agreement between you and Across America about your use of the Site. They do not replace any separate terms you may accept directly from a third-party provider.
